What To Do After An Arrest – Bail

Hello Defense attorney Mark Rosenfeld here.  A common question I get is, “what do I need to do after I have been arrested” and sometimes it’s from the person who’s actually been arrested or sometimes it’s from a family member.  The first thing that people need to focus on is actually getting out of custody.  Getting out of jail, if at all possible, in some situations the person may be released on their own recognizance.  Other times they may be required to post bail.  In order to figure out where the person is and what needs to be done to get them out as soon as possible so they can defend themselves.  It’s a good idea to get the assistance of an attorney and then a bail bondsman.  Some people go directly to the bail bondsmen and that’s fine if you don’t have an attorney selected yet but an attorney will often be able to gather information and be helpful in working with the bail bondsmen to get the person out of custody out of jail and back home as soon as possible.  It is much better to defend a case with a person who is out of custody than have that person sit there to go see a judge and then maybe stay in custody because the prosecution and the police officers have more time to investigate and get more information.  The best thing to do is get the person out and get them home so they can get back to their normal life as soon as possible and then we can proceed with defending the case  If you’ve got questions about being arrested, I practice in Southern California my office is in Beverly Hills you can reach me directly at 310-424-3145 be safe.

Another thing that needs to be done when someone was recently arrested is the person needs to find an attorney.  It’s right up there with getting a bail bondsman.  If they need help getting bailed out and, as I mentioned in an earlier video, that getting an attorney first can actually help you find the person.  Finding the right bail agent (the right bail bondsman) saving money in the long run and defending the case properly.  An experienced defense attorney is going to know what needs to be done to start to prepare a defense.  It’s wonderful that the system says that we are innocent until proven guilty however the reality is police officers and prosecutors are interested in arresting and convicting people.  They’re not necessarily interested in finding the truth.  They should be there to do justice but a lot of times that gets lost and it’s the defense attorney who is going to be able to investigate the case, find the witnesses, find the evidence, find the information, necessary to prove what the prosecution is saying happened didn’t happen.  If you’ve got questions about how to defend the case and when to get an attorney onboard I’m happy to talk.
