The DMV Action Will Permanently Remain on the Driving Record
If somebody is under 21 and they have an administrative action, then the DMV record will show that there was a license suspension and an administrative action against them. That DMV record will last basically forever; there is no real way to remove that from the record.
If somebody is charged in court and they are under 21 but they are charged with 22152, driving under the influence, it’s a regular DUI. It will show up on the record as a regular DUI, and they’ll face the same consequences as somebody who is over 21.
Of course the exception is if they’re under 18. If they’re 17 or younger, then the matter would be handled by the juvenile court and ultimately that record could be sealed.
