SR-22 Insurance Is Proof of Insurance Required by the DMV Following a License Suspension for a DUI Charge
If somebody has their license suspended by the Department of Motor Vehicles, one of the requirements to get the license back is to have insurance. It’s not a regular insurance that you typically would have but it’s a special proof of insurance, which is commonly referred to as the SR-22. That’s the form that the DMV requires.
The SR-22 is proof to the Department of Motor Vehicles that you have, at least, the mandatory minimum insurance coverage and that you maintain that coverage for a minimum of three years. You don’t pay for three years at one time but you have to keep that insurance in place.
The SR-22 puts a burden on the insurance agent, not the person buying the insurance but the person selling the insurance to inform the Department of Motor Vehicles that the person has it. When you buy an SR-22, the insurance company sends by, basically, email to the DMV proof that you have insurance in, at least, the minimum amount required.
The DMV Will Be Notified If You Cancel or Stop Paying the SR-22
This SR-22 gets sent electronically to the DMV and the insurance agent lets them know when it starts and when it stops. If you cancel the SR-22 or you don’t pay on the SR-22, then the insurance agent will notify as required to tell the Department of Motor Vehicles that you don’t have insurance unless you get it someplace else.
The DMV will then send notice to you that your license is suspended because you don’t have insurance in place. The SR-22 puts everybody on notice. It tells your insurance company or other people looking at your driving record that there’s an issue (typically accidents or DUI) requiring a special proof of insurance.
There are things that can be done to save you money with the insurance but the case needs to be handled the right way at the right time. Generally speaking, the SR-22 is proof that you have insurance in, at least, the minimum amount required by law and it gets sent by the agent to the DMV.
